KHORRAMI POLLARD & ABIR SETTLES $2.15 MILLION CLASS ACTION LAWSUIT FOR MODERN TECHNOLOGY/MARIC COLLEGE “RT PROGRAM STUDENTS”

Nearly 100 students compensated for claims they were misled re: eligibility to sit for examination

LOS ANGELES, CA – Khorrami Pollard & Abir LLP (KPA), a national law firm representing plaintiffs, obtained a final settlement for $2.15 million on behalf of certain students who attended Modern Technology/Maric College who believe they were misled regarding their eligibility to sit for the American Registry of Radiological Technologists (ARRT) examination.

The settlement was approved by Judge Rolf Treu of the Los Angeles County Superior Court, who appointed KPA and The Quisenberry Law Firm as class counsel. Robert J. Drexler, Jr. and John Quisenberry led the efforts by their firms. The lawsuit claimed the school deceived students at its North Hollywood California school by means of written materials (the course catalog or course catalog addendum) which misrepresented or intimated that upon completion of the California Radiologic Technician (“RT”) Program, students would be eligible to sit for the ARRT examination when, in fact, the school’s program was not ARRT accredited and the students were unable to sit for the ARRT when they graduated. The case involved claims under California’s Education Code and Unfair Competition Laws. Maric defended the suit vigorously and denied all alleged wrongdoing.

“Unfortunately these students put in tremendous time, effort and money to attain a goal that wasn’t even an option for them,” said KPA founding partner Shawn Khorrami. “We sought just compensation for their injuries and believe that the resulting settlement is fair.”

Settlements were disbursed on May 4, 2010 to each individual class member. Settlement amounts varied, and were determined by a court-approved formula, which included a partial tuition refund and consequential damages for the 22 named plaintiffs.
