Fremont County Attorney Pat LeBrun announced this afternoon that he would not seek robbery charges against Kayleb Roskowske at this time related to the incident occurring at the Good2Go Convenience Store
in the early morning hours of November 18, 2015.
In a news release LeBrun said the following: "Active law enforcement
investigation into the matter has determined that likely no actual robbery
occurred. It has become apparent that at least one of the witnesses in this
case may have provided materially false information to law enforcement.
"Law enforcement is currently investigating the possibility that the
alleged victim of the alleged robbery may have known about the alleged
robbery prior to its occurrence. Further, law enforcement is investigating
the possibility that the alleged victim may have given instructions to the
suspect on how to proceed with the robbery. It is known that the alleged
victim and the suspect were residing in the same residence immediately
prior to the alleged robbery.
"The State cannot lawfully pursue robbery charges under these
circumstances. The investigation into this matter is ongoing."
