Wyoming Association or Risk Management files Interpleader Action to address Station Fire complaints

(Casper, Wyo.) -Following last year's Cole Creek/Station fire the Wyoming Association of Risk Management (WARM) has received fifteen claims against the City of Casper. Under the Governmental Claims Act there is a finite amount of money available for the claims asserted and that is $500,000. According to WARM Executive Director, Joe Constantino, "The total amount available for claims in this matter is five hundred thousand dollars ($500,000), however, the claimants/landowners have alleged damages that far exceed this amount." WARM has recently filed an *interpleader action* in District Court because of the $500,000 liability limit under the Governmental Claims Act and due to the number of claimants. So what that means, according to Constantino, "If the City of Casper is found liable for damages in court, it it left to the court to decide how much money the complaint(s) will receive." It will be left to the courts to determine who gets and how much of the $500,000. According to WARM, they believe that it would be in the best interest of all the parties to be involved in an* interpleader action* in order to determine the legals issues on liability, damages and ultimately disbursement of funds. WARM will be joining all of the Cole Creek/Station Fire claimants to this action in order to consolidate all of the claims and to protect against conflicting claims. ​ #oilcity #news ​
